Terms of Use

These Terms of Use govern your access to and use of BoatShowAvenue, including our website, marketplace, account tools, listings, messaging, advertising, valuation tools, and related services. By accessing or using BoatShowAvenue, you agree to these Terms. If you do not agree, do not use the service.

1. The BoatShowAvenue marketplace

BoatShowAvenue provides an online marketplace where buyers, sellers, dealers, brokers, builders, service providers, and other marine-industry participants can publish information, discover boats and services, communicate, and use related tools. Unless BoatShowAvenue expressly states otherwise in writing, we are not a seller, dealer, broker, lender, insurer, surveyor, escrow agent, or party to a transaction between users.

Listings, prices, availability, specifications, ownership details, condition reports, seller statements, and other marketplace content may be supplied by third parties. You are responsible for independently confirming all material information before making a payment, signing an agreement, arranging transport, or completing a transaction.

2. Eligibility and accounts

You must be legally able to enter into a binding agreement in your jurisdiction to use account features or transact through the marketplace. You agree to provide accurate, current information and to keep it updated. You are responsible for safeguarding your login details and for activity performed through your account.

You must notify us promptly through the support center if you believe your account has been accessed without authorization. We may require identity, authority, ownership, or business verification before enabling or continuing certain features.

3. Listings and seller responsibilities

If you create or manage a listing, you represent that you are authorized to advertise the vessel, product, or service and that the content is accurate to the best of your knowledge. You must disclose material facts that a reasonable buyer would expect to know and promptly update or remove content that is no longer accurate or available.

You may not publish misleading prices, fabricated specifications, copied listings, unlawful goods or services, hidden fees, infringing media, or content intended to redirect users into fraud. BoatShowAvenue may review, edit for formatting, limit distribution of, reject, or remove content that violates these Terms or creates risk for users or the service.

4. Buyer responsibilities and transactions

Buyers must perform appropriate due diligence. This may include confirming the seller's identity and authority, inspecting the vessel, engaging qualified marine surveyors and legal or financial advisers, checking title and liens, reviewing maintenance records, confirming taxes and registration, and using secure payment and closing practices.

BoatShowAvenue does not guarantee the identity of every user, the condition or legal status of a vessel, the accuracy of a valuation, the availability of financing or insurance, or that a proposed transaction will be completed. Any agreement for a purchase, sale, charter, service, inspection, finance product, or other transaction is between the relevant users and providers.

5. User content and license

You retain ownership of content you submit. You grant BoatShowAvenue a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, distribute, and otherwise use that content as reasonably necessary to operate, secure, improve, and promote the service and your listing or profile. This license ends when the content is deleted, except for copies retained for legal, security, backup, or recordkeeping purposes.

You represent that you have the rights and permissions needed to submit the content and grant this license. Do not upload confidential information, personal data about another person without authority, or material that violates intellectual-property, privacy, publicity, or other rights.

6. Messages and communications

When you send an inquiry or message, BoatShowAvenue may deliver it to the relevant user and retain it to provide conversation history, prevent abuse, support users, and operate the marketplace. You agree not to send spam, deceptive solicitations, malware, harassment, or unlawful content.

You may receive service communications about your account, listings, messages, payments, security, and requested alerts. Where permitted, you may also receive promotional communications. You can manage optional communications through available account controls or the unsubscribe method included in a message.

7. Payments, subscriptions, credits, and advertising

Some features may require payment, a subscription, or marketplace credits. Prices, billing intervals, included features, renewal terms, and cancellation options shown at checkout are part of these Terms. Payment processing may be provided by a third-party payment processor and may be subject to that provider's terms.

Except where required by law or expressly stated at purchase, fees and used credits are non-refundable. Marketplace credits have no cash value, cannot be redeemed for cash, and may be subject to expiration or promotional conditions disclosed when issued. You are responsible for applicable taxes and for ensuring that advertising content is accurate, lawful, and properly authorized.

8. Acceptable use

You may not:

  • use BoatShowAvenue for fraud, money laundering, sanctions evasion, trafficking, or another unlawful purpose;
  • impersonate another person or misrepresent your identity, authority, affiliation, inventory, or transaction;
  • scrape, harvest, copy, or systematically extract service data except as expressly authorized in writing;
  • probe, disrupt, overload, reverse engineer, bypass access controls, or introduce malicious code;
  • interfere with another user's use of the service or attempt to obtain unauthorized access to an account or system;
  • use automated systems to create accounts, send messages, manipulate rankings, or generate artificial activity; or
  • use service content or data to build a competing database or service without written permission.

9. Intellectual property

BoatShowAvenue and its licensors own the service software, design, branding, logos, compilation, and other content that we provide, excluding user content. These Terms grant you a limited, revocable, non-transferable right to use the service for its intended purpose. No other rights are granted.

If you believe content on the service infringes your rights, contact us with enough detail to identify the protected work, the disputed content, its location, your contact information, and the basis for your claim.

10. Third-party services and links

The service may link to or integrate with payment processors, map providers, communications providers, analytics services, artificial-intelligence providers, social platforms, and other third parties. BoatShowAvenue does not control their services, content, availability, or privacy practices. Your use of a third-party service is governed by its own terms and policies.

11. Disclaimers

To the fullest extent permitted by law, BoatShowAvenue is provided on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

Search results, comparisons, calculators, price alerts, recommendations, and valuation outputs are informational tools only. They are not appraisals, surveys, professional advice, guarantees, or substitutes for independent inspection and professional judgment.

12. Limitation of liability

To the fullest extent permitted by law, BoatShowAvenue and its owners, affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, business interruption, transaction losses, or disputes between users arising from or related to the service.

Where liability cannot be excluded, our aggregate liability for claims arising from the service will not exceed the greater of the amount you paid directly to BoatShowAvenue during the 12 months before the event giving rise to the claim or USD 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BoatShowAvenue and its owners, affiliates, personnel, and service providers from claims, losses, liabilities, and reasonable costs arising from your content, your use of the service, your transaction or dispute with another user, or your violation of these Terms or applicable law.

14. Suspension and termination

You may stop using the service at any time. We may limit, suspend, or terminate access, remove content, or take protective action when we reasonably believe it is necessary to enforce these Terms, comply with law, protect users, prevent fraud or security harm, or maintain the service. Provisions that by their nature should survive termination will continue to apply.

15. Changes to the service or these Terms

We may update the service and these Terms. We will post the revised Terms and update the date above. If a change materially affects your rights, we will provide additional notice when reasonably required. Continuing to use the service after the effective date of updated Terms means you accept them.

16. General terms

These Terms and any additional terms presented for a specific feature form the entire agreement between you and BoatShowAvenue concerning the service. If a provision is unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a reorganization, financing, merger, acquisition, or transfer of the service.
